Terms and condition

This Site is operated by 5 Initials Limited (”we,” “us” or “our“), a company registered in England and Wales with registration number 4614148. We offer to assess and purchase your property on the terms and conditions set out below. By sending us your property, you accept the terms and conditions.

The terms and conditions below are legally binding on you as a customer in relation to the potential assessment and sale of any items (the "Property") which you send to 5 Initials Ltd (T/A silvergoldintocash.com).

These terms and conditions (the “Agreement”) govern your use of our services. Please read this Agreement carefully before proceeding to use the Site and our Services.  You should keep a copy of this Agreement for future reference.  We will not file a copy of this Agreement.  By continuing to use our Website and our Services you agree that you have read and agree to abide by the terms of this Agreement with us.

1. Requirements for Use and Representations.

You warrant to 5 Initials Ltd. that –

1.1. the information you submit is truthful and accurate;

1.2. you are at least eighteen (18) years of age;

1.3. you are an individual who under this contract is not acting for the purposes of your trade, business or profession;

1.4. you are the legal owner of any Jewellery that you sell or are attempting to sell to us and have full authority to sell the Property;

 1.5. the Property is sold free of all liens, encumbrances, liabilities, and adverse claims of every nature and description whatsoever;

1.6. the Property is not from, or the result of, illegal activity in any part of the United Kingdom or any other country;

1.7. any transaction initiated by you will not cause 5 Initial Ltd to be in violation of any anti-money laundering, anti-terrorism, or other applicable law of any part of the United Kingdom or any other country.

1.8. you are selling or are attempting to sell Jewellery on your own behalf and are not an agent or a representative of a third party.

We reserve the right to request documentation and other proof of compliance with the requirements contained in this Section 1.

2. Shipping and Insurance

2.1. All Property sent to 5Initials Ltd. by you must be sent in the provided packaging (the "Gold Pack"). The tracking applications of the third party carrier, Royal Mail, will be the sole proof that the Property was mailed to 5 Initials Ltd. We strongly advise that you provide the number of items on the customer form which you must return to us.

2.2. By using the Gold Pack, the Property will be insured for five hundred pounds (£500) by Royal Mail. Simply place your unwanted Jewellery into the security pack included in the Jewellery Return Pack, place the security pack in the Special Delivery envelope and take it to a Royal Mail Post Office branch or to your collection driver to get a signed receipt as proof of posting and to be covered by the pre-paid insurance. If you wish to insure your Property for more than five hundred pounds (£500), you must do so at your own expense.

 2.3. In the event your Property is lost or stolen prior to reaching 5 Initials LTD you must make a claim against Royal Mail.

2.4. 5 Initials LTD reserves the right to reject delivery of any package which appears to be damaged, opened, or tampered with on delivery. Any such item will be returned to you without any liability to 5 Initials LTD

2.5. It is your responsibility to obtain a receipt for delivery from the delivery agent. The receipt should include a unique tracking code. This receipt is required for any insurance claim. To submit an insurance claim where items have been lost or stolen, proof of purchase is required. Should an item be lost or stolen before it is proved to be in our possession it is your responsibility to contact the delivery agent to retrieve those items or to submit an insurance claim. We accept no responsibility for items sent to us until they are in our possession. It is our responsibility to contact the delivery agent if your items are lost or stolen after we have sent them to the delivery agent.

2.6. It is your responsibility to keep safe any documentation relating to your item(s) that would be useful in support of an insurance claim, including, but not limited to any purchase receipts, post office receipts, certificates, valuations, insurance documents or photographs.

3. Jewellery Valuation, Possible Damage to your Property, Precious and Semi-Precious Stones, and return of Goods

3.1. Jewellery Valuation

Upon receipt of your Jewellery, we will weigh and evaluate it. We purchase jewellery for its melt value. Except for small diamonds, prices for jewellery are based solely on the weight of your Jewellery and carat grade contained in your Jewellery. For this reason, we cannot pay for gemstones in your Jewellery other than small diamonds. Prices for small diamonds are based upon carat weight, colour, clarity, cut and shape.

3.2. Possible Damage to your Property

 By sending us your Property, you accept that the process of determining a value may involve:

(a) Placing certain acids on your Property and that this can leave permanent staining and/or deep scratches; and

(b) Separating different materials or carat grades in the items included in your Property (including but not limited to watches and items containing different materials or carat grades, stones or non-precious materials). Such items may be destroyed and are not recoverable intact if you decide to reject our valuation of your Property pursuant to section 4.

3.3 Return of Non-Precious Items

 We are unable to pay for Jewellery that does neither contain valuable precious metal nor diamonds (”non-precious items”). In the event that you sent us a non-precious item(s) we will send you a notification by email informing you that the Property does not contain precious metals. If you wish the non-precious items to be returned to you, you must inform us by email to info@silvergoldintocash.com of your wish within 10 days of receiving our email (For the avoidance of doubt, this period starts on the day we send the notification to you and not on the day you receive it. We strongly advise that you provide us with an email address so that you receive the notification as soon as possible.). There will be a £12 charge for handling and administration for returning any goods/ articles. If you do not inform us in time of your wish to have the non-precious items returned, we will assume that you do not want us to return the non-precious items to you and they will be disposed of by us. The 10-day period cannot be altered for any reason, and, subject to Section 6 below, we will not be responsible for any loss of or any damage of any kind to a non-precious item, which you did not ask us to return within the 10-day period.

4 Quote.

We will provide you with an email quote for your Jewellery within 24 hours of receipt of your package.  Items are delivered to 5 Initials LTD five (5) days per week, Monday through Friday, exclusive of UK bank holidays or weekends. In the event the twenty-four (24) hour period referred to above would extend into a weekend or holiday, your Property will be processed the first business day following the holiday or weekend. The twenty-four (24) hour period does not include the time it takes for your payment to be delivered to you.

4.1 Accepting/Rejecting a Quote.

If you wish to accept a quote, please reply to the quote email we send you indicating that you accept the quote. If you would like to talk with a representative about the quote, please respond to the email and let us know what phone number we should call on. We may, in our sole discretion, record the call, and if you orally accept the quote during the call, you will be deemed to have accepted our offer. Email quotes will be valid for a period of 10 days. If you do not accept the quote or do not indicate acceptance within 10 days of us sending you the quote, we will return your Jewellery to you. However we will charge £12.00 for handling and administration and this has to be paid before the jewellery can be returned to you.

We will, in our sole discretion, choose the return carrier, insurance and receipt verification method for each transaction. We will insure your Jewellery for no more than the amount we offer you for your Jewellery, (regardless of what you insure the Jewellery for when you mail it to us), unless you notify us by phone at 02087511768 that you agree to pay for the additional insurance you request. If you believe your Jewellery is worth more than £500, we recommend that you insure your shipment for the value you think it is worth.

If you accept the quote we will send you a cheque within 24hours of your acceptance. 

5 Payment.

 You will be paid by cheque. Please fill out the payment form in your Jewellery Return Pack, and enclose the form with your shipment. We will mail your cheque to the address you have provided to us when you requested your Jewellery Return Pack unless you specify otherwise in writing.

6. Limitation of Liability

 6.1. We will not be liable for loss or damage caused to your Property as described in clause 3, save where caused by our negligence.

6.2. We are not liable to you or any third party (including your insurance company) for any money owed, compensation or indirect loss which happens as a side effect of the main loss or damage (loss or damage which does not arise naturally in the usual course of things, but loss which may reasonably be supposed to have been in the contemplation of both parties, at the time we entered into this Agreement, as the probable results of the breach of it) including lost profits or loss resulting from your use of this Site, Contributions, the Materials or any other content on the Site.

6.3. With the exception of liability for death or personal injury to any person caused by our negligence or that of our agents, which shall be unlimited, our liability to you with respect to any loss suffered by you or by any third party resulting from your use of the Site or our Services, shall not be more than the lower of the following: (a) one-third of the appraised value of all the Jewellery that you submit to us, which appraisal you have obtained from a third party certified appraiser before you shipped the Jewellery to us; OR (b) one hundred pounds (£100). You agree to compensate us for any reasonable loss, liability, claim, or demand, including reasonable lawyer fees, made by any third party due to or arising out of your Contributions, your use of this Site, content on the Site or the Materials in violation of this Agreement and/or arising from a breach of this Agreement and/or any breach of your promises and representations set out above

6.4. Without prejudice of any other of these conditions, any liability of 5 Initials LTD. to you shall be limited to the unwrought value by weight of the precious metal comprised in the Property ("unwrought" means the precious metal in its native state, before being worked on). We will not be liable for loss or damage to materials contained in your Property that Varad International does not offer to purchase, including but not limited to stones and non-precious metals.

7. Ownership and Risk

7.1. Ownership of the Property will pass to us once the payment is issued by us.

7.2. If the Property is lost before it is valued and you wish to make a claim against 5 Initials LTD., you will need to provide evidence of the value of the property as well as the Royal Mail special delivery receipt from the Post Office. We strongly advise that you take a photo of your Property before sending it to us.

8. Return Insurance Liability

8.1. For the return of your Property, in accordance with section 3.3 and 4.1, we will, in our sole discretion, choose the return carrier, insurance and receipt verification method for each transaction. We will insure your Property for no more than our valuation (regardless of what you insure the Property for when you send it to us).

8.2. You assume all risks (and title to the Property reverts back to you) once any Property being returned is handed over by us to the carrier.

8.3. You must make any claim in relation to any defects (for example, missing items) within ten (10) days of receipt of the returned Property. In the event your Property is lost or stolen prior to reaching you, you must make a claim against the carrier.

9. Choice of Law

You and we agree that England and Wales law will apply to this Agreement and the courts of England and Wales will have exclusive jurisdiction in relation to the Agreement.

10. Waiver

5 initials LTD’s failure to exercise or enforce any right or provision of the terms and conditions will not be deemed to be a waiver of such right or provision.

11. Severability

If any court or competent authority decides that any of the provisions of these terms and conditions are invalid, unlawful or unenforceable to any extent, the term will, to that extent only, be severed from the remaining terms, which will continue to be valid to the fullest extent permitted by law.

12. The Contracts (Rights of Third Parties) Act 1999

A person who is not party to these terms and conditions shall not have any rights under or in connection with them under the Contracts (Rights of Third Parties) Act 1999.

13.  Disclaimers.

All contributions or any other materials or items provided through this site are provided "as is" and "as available", without warranty or conditions of any kind.  We shall not be responsible for the contents of the gold chart data appearing on this site. This data is prepared by third parties, and we include this chart only for general informational purposes.

14. Change of Terms and Conditions

We reserve the right to change these terms and conditions from time to time.

15. Survival.

Even after your use of this Site has ended, this Agreement shall remain in effect.

16. Independent Contractors.

Nothing in this Agreement shall be considered to create an agency, partnership, joint venture, employee-employer or franchisor-franchisee relationship of any kind between us and you.

17. Generally

We try our best to adhere to promises as to time limits for the despatch of the Property and cheques but there may be occasions where there are short delays.
